Terms & Conditions

Effective Date: 13 May 2025

These Terms and Conditions ("Terms") constitute a binding agreement between you ("Client" or "you") and all4birding, LLC ("WeBird", "we", "us", or "our") regarding your use of the WeBird platform.

1. The WeBird Platform

WeBird facilitates bookings and payments but is not a party to contracts between Guides and Clients.

2. Booking and Payment

Bookings are direct contracts between Client and Guide. WeBird processes payments on behalf of Guides.

3. Cancellations and Refunds
  • Client Cancellations: Subject to the Guide’s cancellation policy.
  • Guide Cancellations: Full refund unless otherwise specified.
  • No-Shows: May result in no refund.
4. Your Responsibilities
  • Provide accurate account information.
  • Act respectfully and lawfully.
  • Understand and accept the risks of birding tours.
5. Reviews and Content

Reviews must be honest. User content may be used by WeBird under a non-exclusive license.

6. Termination

Clients may terminate accounts at any time. WeBird may suspend or terminate accounts for violations.

7. Dispute Resolution

Disputes are governed by Texas law and may proceed to mediation or arbitration.

8. Privacy Policy

Use of WeBird is subject to our Privacy Policy.

9. Modifications

Terms may change. Continued use constitutes acceptance of the revised terms.

10. Miscellaneous

These Terms represent the full agreement between you and WeBird. If any part is invalid, the rest remains in effect.

1. Platform Overview

WeBird connects Guides with Clients and handles bookings and payments, but is not a party to the contracts.

2. Guide Responsibilities
  • Accurate account and profile setup
  • No subcontracting allowed
  • Tour Operators must list each Guide individually
3. Pricing and Payments
  • WeBird adds a 15% commission on top of Guide prices
  • Payments processed post-service
  • Chargebacks may delay or affect payments
4. Cancellations & No-Shows
  • Guide cancellations = client refund + possible penalties
  • Client no-shows = no refund, guide gets paid (unless disputed)
  • Guide no-shows = refund + possible termination
5. Service Standards

Guides must maintain professionalism, safety, and only communicate through WeBird before/after confirmed bookings.

6. Marketing & Promotion

WeBird can use Guide content for marketing. Guide rankings depend on performance and reviews.

7. Insurance & Liability

Guides must maintain appropriate insurance. WeBird is not liable for incidents during tours.

8. Termination

Guides can terminate with 30-day notice. WeBird may terminate accounts for violations or complaints.

9. Data Protection

Guide misuse of Client data leads to immediate termination and legal action.

10. Legal & Dispute Resolution

Governed by Texas law. Disputes will be resolved via mediation or arbitration.

11. Amendments

Terms may change. Continued use confirms acceptance.

12. Definitions

Clarifies terms like Guide, Client, Platform, Commission, No-Show, and Termination.

13. Tour Operator Policy

Operators may assist Guides, but direct Guide engagement is mandatory. No substitutions allowed. Payouts go directly to Guides.
