Introduction
These Terms and Conditions ("Terms") constitute a binding agreement between you ("Client" or "you") and all4birding, FZ-LLC, the owner of the WeBird brand ("WeBird," "we," "us," or "our").
These Terms govern your access to and use of the WeBird platform, including our website, mobile applications, and related services (collectively, the "WeBird Platform").
By accessing or using the WeBird Platform, Clients agree to comply with and be bound by these Terms.
If Clients do not agree to these Terms, they may not use the WeBird Platform.
1. The WeBird Platform
1.1 Role of WeBird:
WeBird, a service provided by all4birding, FZ-LLC, is an online marketplace that enables Clients to discover, book, and pay for birding tours offered by independent third-party guides ("Guides").
WeBird does not own, control, offer, or manage any listings or Guide services.
When you book a tour through the WeBird Platform, you are entering into a direct contract with the Guide.
WeBird is not a party to the contracts entered into directly between Clients and Guides, nor is WeBird a travel agency, insurer, or organizer of travel packages.
WeBird merely facilitates bookings and payments. The terms and conditions, including cancellation policies, which apply to your booking are available on the WeBird website and apps.
2. Booking and Payment
2.1 Booking:
When you submit a booking request through the WeBird Platform, this constitutes a non-binding request to the selected Guide.
No payment is due at this stage. A booking becomes eligible for payment only once the Guide has explicitly accepted your booking request.
Upon the Guide’s acceptance, you will receive a confirmation email from WeBird.
2.2 Payment:
Upon receipt of the email confirming the Guide’s acceptance of your booking request, a “Pay now” button will appear in the booking overview within your WeBird account.
To confirm your booking, you must complete payment through the WeBird platform within the applicable timeframe, calculated from the moment of the Guide’s acceptance:
- (a) Bookings for trips starting more than forty-eight (48) hours after acceptance: payment must be completed within forty-eight (48) hours;
- (b) Bookings for trips starting within forty-eight (48) hours of acceptance: payment must be completed within six (6) hours.
Failure to complete payment within the applicable timeframe will result in the automatic cancellation of the booking request without further notice.
No contractual relationship with the Guide shall arise unless payment is completed in time.
You agree to pay all charges associated with your booking, including the tour price, applicable fees, and taxes.
Payments are processed by WeBird on behalf of the Guide.
2.3 Payment Processing:
WeBird facilitates payments and collects funds from Clients on behalf of Guides.
Payments will be processed after completion of the agreed-upon Services for any given booking and transferred to the Guide's designated payment account within 48 hours, not accounting for any bank processing times.
Guides offering Bundled Services (beyond simply guiding) and who require an advance to meet supplier demands (such as, but not limited to, hotel reservations), can do so directly to WeBird.
In such cases, supporting documents will need to be provided and WeBird will decide the amount and timing of an advance payment, if necessary in consultation with the Client.
Such advances will be deemed non-refundable, unless otherwise indicated.
3. Cancellations and Refunds

4. Your Responsibilities
4.1 Account Information:
You must provide accurate and complete information, including legal name, address, contact details, and payment details (and other details as may be required in the account setup procedure) when creating an account on the WeBird Platform and keep your account information up to date.
4.2 Conduct:
You are responsible for your own conduct and the conduct of any other members of your party.. You agree to act with integrity, treat others with respect, and comply with applicable laws, regulations and customs at all times during your use of the WeBird Platform and participation in tours.
4.3 Assumption of Risk:
You acknowledge that participating in birding activities involves inherent risks, including but not limited to outdoor activities and wildlife encounters.
You agree that you participate in tours at your own risk.
5. Reviews and Content
5.1 Reviews:
After completing a tour, you may have the opportunity to leave a review.
Reviews must be honest, respectful, and comply with any content guidelines that WeBird may establish if needed and of which you will be informed.
5.2 User Content:
By submitting content (e.g., reviews, photos) to the WeBird Platform, you grant WeBird a non-exclusive, worldwide, royalty-free license to use, copy, modify, and display such content in connection with the WeBird Platform.
6. Termination and Suspension
6.1 Termination by Client:
You may terminate your account at any time through your account settings.
Upon termination, any confirmed bookings will be canceled, and applicable cancellation policies will determine any refunds.
6.2 Termination by WeBird:
WeBird may suspend or terminate your access to the WeBird Platform if you violate these Terms or engage in conduct that harms the WeBird community or platform.
7. Dispute Resolution
7.1 Governing Law:
These Terms shall be governed by and construed in accordance with the laws and regulations of the Ras al Khaimah Economic Zone, United Arab Emirates, without regard to its conflict of law principles.
7.2 Dispute Resolution:
In the event of a dispute, you agree to first attempt to resolve the issue informally by contacting WeBird customer service.
If the dispute cannot be resolved informally, it will be resolved through mediation or arbitration, as permitted by applicable law.
8. Privacy Policy
WeBird respects your privacy. Our collection and use of personal information in connection with your access to and use of the WeBird Platform is described in our Privacy Policy, which is available on our website.
By using the WeBird Platform, you agree to the terms of the Privacy Policy.
Upon request, you will be able to access and delete your data, as required by UAE Data Protection Laws.
WeBird adheres to the UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data.
9. Modifications to Terms
WeBird may modify these Terms at any time. When we make material changes to these Terms, we will post the revised Terms on the WeBird Platform and update the "Effective Date" at the top.
We will also notify you of significant changes by email or through the Platform.
Your continued use of the WeBird Platform after the effective date constitutes your acceptance of the changes.
10. Miscellaneous
10.1 Entire Agreement:
These Terms constitute the entire agreement between you and WeBird regarding your use of the WeBird Platform.
10.2 Severability:
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
10.3 No Waiver:
WeBird’s failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.
11. Contact Information

These Supplier Terms and Conditions ("Agreement") are entered into between all4birding FZ-LLC ("WeBird") and the Guide ("Guide").
This Agreement governs the relationship between WeBird and the Guide and the services provided through the WeBird platform.
1. WeBird Platform
WeBird operates an integrated online booking and payment platform connecting traveling birders (“Clients”) with local birding guides (“Guides”).
Through the WeBird Platform, :
- Guides can manage their profile, list their services, and handle their availability.
- WeBird facilitates bookings and payments but is not a party to contracts between Guides and Clients.
WeBird, a service provided by all4birding, FZ-LLC, is an online marketplace that enables Clients to discover, book, and pay for birding tours offered by independent third-party guides ("Guides").
WeBird does not own, control, offer, or manage any listings or Guide services.
WeBird is not a party to the contracts entered into directly between Clients and Guides, nor is WeBird a travel agency, insurer, or organizer of travel packages.
WeBird merely facilitates bookings and payments but is not a party to contracts between Guides and Clients.
2. Guide Responsibilities
2.1 Account Setup: Guides must provide complete and accurate information, including but not limited to legal name, address, contact details, applicable licenses, payment details, and profile picture.
2.2 Login Credentials: Guides must keep their account credentials secure. Unauthorized access must be reported to WeBird immediately.
2.3 Service Listings: Guides must ensure their profile, service descriptions, pricing, and availability are up-to-date and accurate.
A Guide who accepts a booking must personally conduct the tour.
Subcontracting or replacing the Guide with another individual is strictly prohibited.
Each Guide within an operator’s network must accept and fulfill their own bookings without substitution.

3. Pricing and Payments
A Client’s payment obligation arises only once the Guide has accepted the booking request.
Upon acceptance, the Client receives a confirmation email and is required to complete payment through the WeBird platform within the timeframe specified in the Client Terms and Conditions:
- (a) Bookings for trips starting more than forty-eight (48) hours after acceptance: payment must be completed within forty-eight (48) hours;
- (b) Bookings for trips starting within forty-eight (48) hours of acceptance: payment must be completed within six (6) hours.
Guides are responsible for their own tax management.
Therefore, Guides do not need to take into account commissions when calculating their own prices, WeBird will automatically add its commission to the price as decided upon by the Guide.
Payments will be processed after completion of the agreed-upon Services for any given booking and transferred to the Guide's designated payment account within 48 hours, not accounting for any bank processing times.
Guides offering Bundled Services (beyond simply guiding) and who require an advance to meet supplier demands (such as, but not limited to, hotel reservations), can do so directly to WeBird.

4. Cancellations and No-Shows
The cancellation provisions below apply exclusively to confirmed bookings for which Client payment has been successfully completed within the specified timeframe;
automatically cancelled booking requests due to non-payment are excluded.

5. Service Standards
5.1 Professionalism: Guides must conduct themselves professionally and provide a high standard of service to Clients.
Guides are responsible for their own tax management and compliance.
All communication before any booking is made, and any communication before the beginning of a confirmed booking and after the end of a booking, must take place through WeBird’s messaging function.
Any breach of this article may result in immediate termination of the Guide’s account and renders any rights, protections and recourses null and void.
6. Marketing and Content
6.1 Use of Guide’s Content: By listing on WeBird, Guides grant WeBird the right to use their photos, descriptions, and other content for marketing and promotional purposes.
6.2 Promotion and Rankings: WeBird may use algorithms to determine search rankings and promote certain Guides based on performance, reviews, and engagement.
7. Insurance and Liability
7.1 Insurance: Guides are required to have all required and appropriate insurances covering their Services and any incidents occurring when carrying out their Services, particularly but not limited to personal liability, accidents, and cancellations.
7.2 Liability: WeBird is not responsible for any loss, injury, or damage arising from the Services provided by Guides.
8. Termination and Suspension
This may be done through the ‘delete my account’ function on the WeBird platform.
Termination of the Guide account will not result in any refund of membership fees, if applicable.
Any confirmed bookings on the Guide account need to be fulfilled or cancelled by the Guide before the account can be confirmed as terminated by WeBird.
Outstanding payments by WeBird will be processed per standard procedures.
- Misrepresentation of services
- Failure to fulfill bookings
- Unprofessional conduct
- Customer complaints
Any outstanding payments due to the Guide may be processed per standard procedures, or, in case the Guide account has been terminated for breaches of this Agreement or other legal cause, may be withheld until such time as these breaches and any potentially resulting damages to WeBird or Clients have been satisfactorily resolved.
9. Data Protection
WeBird complies with applicable data protection laws, notably UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data.
Upon request, Guides will be able to access and delete their data, as required by UAE Data Protection Laws.
Guides must not misuse Client data or use it for purposes other than fulfilling bookings.
Any breach of this article by the Guide will result in immediate account termination and WeBird reserves the right to undertake legal action to the fullest extent of the law against Guides who violate this article.
10. Governing Law and Dispute Resolution
10.1 Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction from which all4birding FZ-LLC operates, to wit the Ras Al Khaimah, United Arab Emirates.
10.2 Dispute Resolution: Disputes will first be attempted to be resolved amicably.
If unresolved, disputes will be settled through mediation or arbitration in accordance with UAE regulations.
11. Amendments
WeBird may update these Terms and Conditions at any time.
Guides will be notified of any significant changes, and continued use of the platform constitutes acceptance of the revised terms.
12. Definitions
- Agreement:
- This Supplier Terms and Conditions document.
- Guide:
- An individual providing guided birding services through the WeBird platform.
- WeBird:
- all4birding FZ-LLC, the company operating the online platform.
- WeBird and WeBird Platform:
- The integrated online booking and payment system connecting Clients with Guides.
- Client:
- A user who books a guided tour through the WeBird Platform.
- Login Credentials:
- The username and password required to access a Guide's account on the WeBird Platform.
- Tour Operators:
- Entities managing multiple Guides who list their Services individually on the WeBird Platform.
- Commission:
- The percentage of booking revenue retained by WeBird as a service fee.
- Chargeback:
- A payment dispute initiated by a Customer with their payment provider.
- No-Show:
- A situation where a Guide fails to appear for a scheduled tour without prior notice.
- Termination:
- The cessation of a Guide’s ability to use the WeBird Platform.
- Liability Insurance:
- A policy covering risks associated with a Guide’s services.
13. Tour Operator or Other Organizations Participation Policy
WeBird enables direct connections between local guides ("Guides") and clients through an integrated booking and payment platform.
While the platform is designed primarily for individual Guides, Tour Operators, Community Organizations or other legal or de facto organizations may also assist Guides in accessing the platform, provided that the core principles of authenticity, transparency, and direct engagement are upheld.
Tour Operators or other Organizations may support Guides in the creation and maintenance of their WeBird profiles.
This support may include logistical assistance, training, or financial support.
However, each Guide profile must represent an individual who will personally provide the Services for each confirmed booking.
Operators/Organizations may not manage bookings or communications on behalf of Guides.
Each Guide listed on the WeBird Platform must be the individual conducting the tour.
Substitution of the listed Guide with another individual—whether by the Tour Operator/Organization or the Guide—is strictly prohibited.
This policy safeguards the integrity of the booking process, ensures the integrity of the selection, communication, and review process and maintains Client trust.
Violation of this policy may result in permanent removal from the WeBird Platform of the involved Guide account(s) and any profiles affiliated with the same Tour Operator/ Organization.
All communications with Clients and with WeBird must be handled directly by the Guide associated with the listed profile.
The Guide is solely responsible for ensuring that all information regarding their Services, pricing, availability, and qualifications remains current and accurate.
WeBird will remit payouts for completed tours directly to the Guide.
Tour Operators/Organizations are not authorized to receive payments on behalf of Guides.
If a Guide and a Tour Operator/Organization agree to a financial arrangement for administrative or operational support, such arrangements must be handled independently of WeBird.
Where additional services such as transportation or lodging are involved, separate agreements between the Guide and the third-party provider may apply.
All such additional services and arrangements between the Guide and any third party must be handled directly by the Guide and independently of WeBird.
This Operator/Organization Participation Policy is a foundational framework and may evolve as WeBird continues development and expansion.
By using the WeBird Platform, Guides agree to abide by these Terms and Conditions and uphold the integrity of WeBird and the birding experience of Clients worldwide.
